Associate Counsel for Health Services-Office of General Counsel
The candidate will serve as liaison between two medical schools, Office of General Counsel and university’s Office of Risk Management and Insurance about areas of potential exposure to liability at SOM/CMSRU. Provide counsel as required for all medical school-related legal concerns. Negotiate, draft, and revise agreements, including the following: Professional Services Agreements designating University professionals to provide services outside the University and retaining professionals outside the University to provide services for the University, consistent with all procurement and other statutory requirements; Affiliation Agreements whereby medical students and house staff go to facilities outside the University for specified training and whereby students and house staff from other institutions come to the University for specified training; Leases and Licenses for real property, use of equipment and personnel; Clinical Trial Agreements covering non-disclosure and confidentiality agreements as well as agreements specifying the conditions of the conduct of the trial. Supervise the release of medical records in response to court orders, subpoenas and consents, with special attention to the following areas: Release of counseling records in compliance with New Jersey Victim Counselor’s Privilege; Release of medical and research records in compliance with HIPPA and IRB regulations. Provide advice and support in the following areas: Medical student disciplinary and performance matters; Housestaff disciplinary and performance matters; Faculty disciplinary and performance matters. Research questions: Protection of human subjects; Institutional Review Board; Scientific misconduct; Interpretation and application of AAUP and CIR contracts; Policies and procedures of both medical schools; Serve as Quality Committee staff member for either or both medical schools. The candidate should have Juris Doctor Degree. Admitted to NJ Bar preferred. 5+ years of experience required.
