Job Overview

A law firm seeks a Data Privacy and Cybersecurity Associate Attorney to join its growing team in Miami, FL. This role focuses on advising clients on privacy compliance, cybersecurity incident response, and data governance within the Healthcare, Life Sciences, and Technology sectors. The position offers a hybrid work environment, allowing for remote work two days per week.

Duties

• Advise clients on privacy compliance, including U.S. state privacy laws, GDPR, global privacy issues, and federal laws such as GLBA and HIPAA.
• Draft, review, and negotiate privacy policies, data processing agreements, and related documentation.
• Provide counsel on the use of cookies and other tracking or data collection technologies.
• Manage cybersecurity and incident response matters, including breach response, ransomware events, and engagement with regulators and state attorneys general.
• Support time-sensitive cybersecurity incident response efforts, including availability outside regular business hours when necessary.

Requirements

• 3-6 years of experience in data privacy and cybersecurity matters.
• Excellent drafting, written, and verbal communication skills.
• Strong legal research, analytical, and technical abilities.
• Proven ability to manage complex matters with high accuracy, organization, and attention to detail.
• Ability to work both independently and collaboratively in a team environment.
• Admission to the bar in the jurisdiction where the candidate will be resident, and in good standing, is required.

Education

• Juris Doctor (J.D.) degree from an accredited law school.

Certifications

• Active bar admission in the relevant jurisdiction.

Skills

• Experience with data governance and information risk, including retention, records, vendor risk, data transfers, and regulatory risk assessments.
• Background in privacy and cybersecurity due diligence, including buy-side and sell-side diligence, data transfer reviews, and investment privacy/security diligence.
• Experience in regulatory investigation counseling, including representing clients in non-litigation administrative matters before the FTC, HHS, state attorneys general, and law enforcement.
