Duties Description
The New York State Coastal Management Program, authorized by the federal Coastal Zone Management Act, is administered through the Office of Planning, Development and Community Infrastructure at the Department of State. Through this enormously powerful environmental law, our staff help to protect and restore the State’s natural and coastal resources, water quality, and the working waterfronts while protecting its natural resources for future generations. We ensure development activities proposed in or affecting our coastal area are consistent with the enforceable policies of the New York State Coastal Management Program, and provide technical assistance to other agencies, local governments, and partners with respect to waterfront revitalization, consistency review, watershed planning, and coastal resiliency.
If you are interested in working with a dynamic program office in this growing practice area, apply today!
The incumbent will be the lead program attorney to the New York State Coastal Management Program and will be responsible for:
• Providing legal advice and support to the Coastal Management Program staff on matters as they arise.
• Providing legal review of consistency determinations prepared under the authority of the Coastal Zone Management Act, ensuring the agency’s determination is supported by the record and in accordance with federal laws, regulations, and prior state and federal agency determinations.
• Managing the Department’s response to appeals to the National Oceanic and Atmospheric Administration (NOAA) by private parties contesting Department of State consistency decisions, compiling relevant records relating thereto, preparing legal briefs, and updating OPD staff regarding the status of such appeals, and working with the Attorney General’s office on any federal litigation stemming from an adverse decision from NOAA.
• Providing legal counsel to the Department in connection with its participation in Public Service Law Article VII proceedings relating to the siting of energy-related projects, such as transmission lines related to the development of off-shore wind facilities.
• Providing legal reviews and preparing opinions on the sufficiency and enforceability of Local Waterfront Revitalization Program (LWRP) applications and amendments submitted to the Secretary of State for review and approval pursuant to Article 42 of the Executive Law and ensuring they meet federal requirements for approval under the Coastal Zone Management Act.
• Providing legal advice to local governments, their committees, municipal attorneys, and consultants in the preparation of legally sufficient LWRPs.
• Providing legal assistance on various coastal matters as they arise, including shipwrecks, fisheries, significant habitat areas, and other underwater resources.
• Supervising one or more senior attorneys assigned to matters within the Office of Planning and Development.
• Reviewing and drafting proposed legislation in relevant topic areas.
• Assisting with FOIL reviews as needed.
